Common Offences and Penalties
If MPFA detected any breaches of the ORSO, it may take actions against the following:
- non-compliant ORSO schemes
- employers, trustees and administrators of the schemes
- any persons committing offences under the ORSO
MPFA may take one or more of the following measures:
- criminal prosecutions
- cancellation of registrations
- withdrawal of exemption certificates
- applying for court orders to freeze assets
- application to court for winding up the scheme
- issuance of compliance advice letters
