Termination of Scheme / Withdrawal of Exemption Certificate

a. Termination of Scheme
i. Termination of Registered Scheme
Where a registered scheme is terminated or otherwise wound up, the relevant employer and designated person of the scheme shall within 14 days of the commencement of the winding up or termination process give a notice in writing of that fact to the MPFA and each member of the scheme. Please complete the notice:

Please be reminded that if a registered scheme is terminated during a financial year, the final annual return, audited financial statements and auditor’s report shall still be provided to the MPFA. For details, please refer to Documents to be Provided Annually:a. Annual Written Statement / Annual Return / Actuarial Certificate for Registered Scheme.
ii. Termination of Exempted Scheme
Where an exempted scheme is terminated in its entirety or the operation of the scheme in Hong Kong was terminated, please complete the notice:

b. Withdrawal of Exemption Certificate
*Applicable to MPF exempted ORSO schemes only
On an application in writing, the MPFA may withdraw an ORSO scheme’s exemption certificate if:
- any of the grounds for withdrawal applies; and
- if the certificate is withdrawn, the relevant employer of the ORSO scheme will not thereby be in breach of the provisions of the Mandatory Provident Fund Schemes Ordinance.
The application for withdrawal of exemption certificate shall be signed:
- if the applicant is a sole proprietor or a partnership - by the sole proprietor or at least 2 partners of the partnership, as appropriate; or
- if the applicant is a company - by at least two of the directors of the company.
